These Terms of Service, Liability Waiver, and Privacy Policy (together, this "Agreement") are entered into between you and 10D Club LLC ("GPCommit", "we", "our", "app", "website", "service", "platform", or "us"). By checking the "I Agree" box and creating an account, you confirm that you have read, understood, and accepted this Agreement.
You must actively check the "I Agree" box to use this service. By doing so, you agree to be bound by this Agreement. If you do not agree, you may not use the service. The service is not for children under 13, and we do not knowingly collect personal information from children under 13.
We provide a platform where users can record and upload track-session telemetry data such as lap times, GPS, and motion sensor readings. This includes mobile applications (iOS and Android) that use your device's built-in sensors to log telemetry data during a track session. The mobile apps may also optionally record video during a session. Additionally, users may connect third-party sensor systems (such as OBD-II adapters or external GPS units) to their device; data from such systems may be captured as part of the session log. Telemetry data, video, and third-party sensor data are stored locally on your device during recording and uploaded to GPCommit's servers upon completion of the session. Our system generates analysis and feedback for informational purposes only. Certain advanced features, including lap optimization analysis, require a paid subscription or one-time purchase as described in Section 9. The service must not be used while operating a vehicle. All analysis should be reviewed only off-track or when safely parked.
When you register, we collect your name, email address, and any account-related information you provide. We do not collect biometric or medical data. Our mobile logging applications access your device's GPS and motion sensors (accelerometer, gyroscope) solely to record telemetry data during a track session. If you enable video recording, the app will access your device's camera and microphone; recorded footage may incidentally capture other people, vehicles, or surroundings at the track. If you connect third-party sensor systems to your device, data from those systems is captured and treated the same as device telemetry. The app may also access your device's photo library to save processed videos with telemetry overlays. All session data — including telemetry, video, and third-party sensor data — is stored locally on your device during an active session and is then uploaded to and stored on GPCommit's servers. We use this information to create and manage your account, provide and improve the service, and generate analysis. We may send you service and promotional emails, and you can unsubscribe at any time. We may share limited information with service providers who help us operate the platform, but only as necessary and under confidentiality obligations. Some analysis features are powered by third-party AI services; only telemetry data (not personal information such as your name or email) is shared with these providers for the purpose of generating analysis. We use reasonable safeguards to protect your data, but no system is perfectly secure. We retain account and telemetry data only as long as needed to provide the service or as required by law, then delete or anonymize it. You may request deletion of your account and data at any time by contacting us. Some regions, such as California and the European Union, grant additional rights such as access and portability, which we will honor.
You acknowledge that track driving is inherently dangerous and assume all risk of injury, death, or property damage arising from participation. We are not responsible for accidents, injuries, or damages resulting from use of the platform or reliance on its analysis. You are solely responsible for safely mounting and positioning your mobile device such that it does not obstruct your vision, distract you, or create a hazard. GPCommit is not liable for any injury, damage, or loss arising from how you mount, position, or interact with your device. GPCommit makes no representations regarding the accuracy or reliability of data from third-party sensor systems; you assume all responsibility for how such data is interpreted and acted upon. You waive any claims against us and agree not to hold us liable for harm or losses connected with your use of the service. To the fullest extent permitted by law, this waiver and limitation of liability does not apply to gross negligence, willful misconduct, or where prohibited by law.
The service is provided "as is," with no warranties of any kind, express or implied. We do not guarantee accuracy, completeness, or that our analysis will improve your performance or safety.
This Agreement is governed by the laws of the United States. Any claim must be brought within one year after it arose, or it is waived.
If any provision of this Agreement is held unenforceable, the remainder stays in effect. We may update these Terms, and continued use of the service after notice of changes constitutes acceptance of the revised Terms.
Certain features of the service, including lap optimization analysis, require payment. By purchasing a subscription or one-time feature, you agree to pay all applicable fees. All payments are processed through our third-party payment provider. All sales are final and we do not offer refunds except where required by applicable law. If you have a subscription, you may cancel at any time; cancellation takes effect at the end of the current billing period and you will retain access to paid features until that date. GPCommit reserves the right to change pricing at any time with reasonable notice. Failure to pay may result in suspension or termination of access to paid features.
